AQUAPOD Head to Toe Healthy "CONTEST"
OFFICIAL RULES

TO PARTICIPATE, ALL ENTRANTS MUST BE CURRENT LEGAL U.S. RESIDENTS CURRENTLY RESIDING IN ANY OF THE 50 UNITED STATES or WASHINGTON DC, 18 YEARS OF AGE OR OLDER, AND HAVE INTERNET ACCESS AS OF 9/12/07. To enter the Contest, visit www.aquapodmoms.com ("Web Site") between 12:00:01 AM ET on 9/12/07 and 11:59:59 PM ET on 10/31/07 ("Contest Entry Period") and complete an Official Entry Form, including full name, address (no P.O. boxes), city, state, zip code, e-mail address, daytime telephone number (including area code) and date of birth. Follow the instructions and upload your original and unpublished photo showing how you used one or more Aquapod® bottles in a fun, imaginative and creative way. Contestant must have written permission from all persons featured in the photographs, including, without limitation, the parents or legal guardians of minors, and the owners of all private property and any trademarks appearing in the photographs in order to post said photographs and grant permission to Sponsor herein to display such photographs on the web site. Photos must be in GIF (.gif) or JPEG (.jpg) format. File size must be no smaller than 25KB and may not exceed a file size of 200 KB. File size must be a minimum 400 pixels high or wide. Limit one entry per person, household or address.

Only entries received during the Contest Entry Period and designated by Sponsor, in its sole discretion, to be posted on the Web Site for the Contest Judging will be eligible to win a Prize. Contestants each warrant that their entry is original, does not violate any law, regulation or right of any third party, including, but not limited to copyright, rights of publicity and/or privacy, that entry is their own work, and that Contestant has followed the Official Rules of this Contest. Eligible entries received will be reviewed by Sponsor for compliance with the Official Rules and entry parameters set forth herein and, at Sponsor's sole discretion, will be posted online at www.aquapodmoms.com on or about 11/1/07. The Sponsor reserves the right in its sole discretion to decide if an entry is inappropriate for posting and may disqualify any entry at any time in the event it is determined, in the Sponsor's sole discretion, that the entry is not appropriate for any reason, including, but not limited to, the inclusion of references to alcohol, objectionable or offensive images or that the Contestant has not complied with these Official Rules. Any entry that prompts a legal challenge or any reasonable complaint, in Sponsor's sole discretion, will be removed and disqualified and any physical or monetary prize awarded in connection with any such submission will be forfeited. Once submitted, an entry may not be changed, altered or modified by Contestant. Sponsor reserves the right to delete any entry in its entirety.

Sponsor not responsible for blurred, out of focus, dark or unclear photographs or technical issues arising from Sponsor uploading photo from entry submission onto the Web Site. By entering this Contest, entrants accept and agree to be bound by these Official Rules and the decisions of the judges, which shall be final, binding and conclusive on all matters. All entries become the exclusive property of the Sponsor and will not be returned or acknowledged. Contest Entry Period ends 10/31/07.

PUBLIC VOTING: Once the photographs have been posted on the web site, visitors to the web site will be asked to vote for their favorite photograph. Public voting begins on or about 11/1/07 and ends 11/30/07. Visitors to the web site can follow the instructions posted on-screen to register to vote once per day. A day is defined as 12:00:01 AM ET through 11:59:59 PM ET. Each eligible vote gives the voter one automatic entry into the Aquapod Head to Toe Healthy Sweepstakes. JUDGING: Official Judging: Each photograph will be judged on or about 12/13/07 by a judging panel selected by Sponsor in its sole discretion on the following criteria: Use of Aquapod bottle with label (30%), Originality (30%), Functional use of depicted creation (20%), Educational Value (10%) and result of Public Voting (10%). Public voting begins on or after 11/1/07 as described above.

The judging panel will disqualify professional and/or previously published photographs and images that the judging panel in its sole discretion believes to be inappropriate for any reason. Based on the decisions of the judges and the judging scores as determined by the judges, which are final, the prizes listed below will be awarded. In case of a tie, the entry with the highest score for Originality will be declared the winner. In the event a tie still remains, the entry with the highest score for Use of Aquapod bottle with label will be declared the winner. In the event another tie remains, the entry with the highest score for Functional use of depicted creation will be declared the winner. In the event not enough qualified entries are received, Sponsor need not award more prizes than entries received. Fulfillment agent will attempt to notify potential prizewinner by telephone. Potential prizewinner will be notified by telephone at the daytime number listed on his/her Official Entry Form. If, after two (2) attempts, contact has not been made, prize will be forfeited and an alternate winner will be randomly selected. Fulfillment agent must reach potential winner; messages will not be left. Prizes will be delivered 6 to 8 weeks after winner verification.

PRIZES: GRAND PRIZE (1): One (1) Grand Prize winner will receive a vacation to Costa Rica for winner and three (3) of winner's guests from choice of ONE of the following trip packages:
•   Arenal Volcano and Hot Springs - Trip includes round-trip coach airfare for Grand Prize winner and three (3) guests from the major airport nearest the winner's residence to San Jose, Costa Rica, a six-night hotel stay for four (4) at the Intercontinental Hotel in San Jose (standard room, double-occupancy accommodations), airport and hotel transfers and $500 spending money. Trip also includes four (4) tickets to a tour of the Arenal Volcano and Hot Springs. Tour includes a local guide, transportation to and from hotel, lunch, and entrance fee. Tours are public and are not exclusive to prizewinner and guests. (Total Approximate Retail Value (ARV): $6,994.00)
•   White-Water Rafting Pacuare River - Trip includes round-trip coach airfare for Grand Prize winner and three (3) guests from the major airport nearest the winner's residence to San Jose, Costa Rica, a six-night hotel stay for four (4) at the Intercontinental Hotel in San Jose (standard room, double-occupancy accommodations), airport and hotel transfers, and $500 spending money. Trip also includes four (4) tickets to go White-Water Rafting in the Pacuare River including a local guide, transportation to and from hotel, one day's breakfast, one day's lunch and equipment for the rafting trip. White-water rafting is a public trip and is not exclusive to prizewinner and guests. (Total ARV: $6,780.00)
•   Rain Forest Aerial Tram - Trip includes round-trip coach airfare for Grand Prize winner and three (3) guests from the major airport nearest the winner's residence to San Jose, Costa Rica, a six-night hotel stay for four (4) at the Intercontinental Hotel in San Jose (standard room, double-occupancy accommodations), airport and hotel transfers and $500 spending money. Trip also includes four (4) tickets for the Rainforest Aerial Tram including a local guide, transportation to and from hotel, one day's lunch and entrance fee. Tours are public and are not exclusive to prizewinner and guests. (Total ARV: $6,730.00)
•   Canopy Adventure - Trip includes round-trip coach airfare for Grand Prize winner and three (3) guests from the major airport nearest the winner's residence to San Jose, Costa Rica, a six-night hotel stay for four (4) at the Intercontinental Hotel in San Jose (standard room, double-occupancy accommodations), airport and hotel transfers and $500 spending money. Trip also includes four (4) tickets to a tour of the tropical rain forest canopy. Tour includes a local guide for the duration of the tour, transportation to and from hotel, refreshments and equipment. Tours are public and are not exclusive to prizewinner and guests. (Total ARV: $6,680.00)


All other expenses not specifically stated herein, including but not limited to taxes, gratuities, meals, and rental car are the sole responsibility of Grand Prize winner and guests. Blackout dates and other restrictions may apply. Grand Prize winner and guests must be able to travel between 3/31/08 and 12/31/08 and must provide travel coordinator with a minimum of 60 days notice prior to intended travel departure. In the event any guest is a minor, guest(s) must be accompanied by his/her parent or legal guardian. Grand Prize winner and guests must travel on the same itinerary. If Grand Prize winner and his/her guests cannot travel on those dates, prize will be forfeited and alternate winner will be randomly selected. Grand Prize packages vary in degree of physical exertion by winner and guests. Sponsor is not responsible for winner's or guests' inability to participate in any prize due to physical or other restrictions and Sponsor is not responsible for any injury, whatsoever, which may occur. Sponsor not responsible for substituting tickets in the event of destination trip cancellations or postponements or winner or guests being unable to participate due to physical or other restrictions. If any destination trip is cancelled or postponed, no alternate prize will be awarded. Grand Prize winner and guests must adhere to pre-arranged itinerary. Sponsor is not responsible for weather conditions, travel cancellations, delays, and postponements or blackout dates. (Total Average ARV for the Contest Grand Prize: $6,796.00)

RUNNERS-UP: Nine (9) runners-up will each receive one the following prizes as determined by their final Contest score as determined by the judges in their sole discretion;
FIRST PRIZE (1): One (1) First Prize winner will receive one (1) electric powerboat (make and model to be selected by Sponsor). Electric powerboat can be turned on with the flip of a switch. Big enough for two kids or for a parent and a child. Boat features a cannon that shoots water up to 30 feet. Includes custom water decal, one position. Specifications are approximately 7 feet by 4.5 inches. (ARV of First Prize: $2,155.00)
SECOND PRIZE (1): One (1) Second Prize winner will receive one (1) stationary basketball system (make and model to be selected by Sponsor). (ARV of Second Prize: $1,900.00)
THIRD PRIZE (1): One (1) Third Prize winner will receive four (4) mountain bikes (makes and models to be selected by Sponsor). (ARV of each Third Prize: $425.00) (ARV of all Third Prizes: $1,700.00)
FOURTH PRIZE (1): One (1) Fourth Prize winner will receive one (1) pedal boat (make and model to be selected by Sponsor). (ARV of Fourth Prize: $875.00)
FIFTH PRIZE (1): One (1) Fifth Prize winner will receive one (1) family camping set (make and model to be selected by Sponsor). Camping set includes tent, sleeping bags, sport grill and cooler. (ARV of Fifth Prize: $1,400.00)
SIXTH PRIZE (1): One Sixth Prize winner will receive one (1) Tennis Table (make and model to be selected by Sponsor). (ARV of Sixth Prize: $1,160.00)
SEVENTH PRIZES (3): Three (3) Seventh Prize winners will each receive one (1) Nintendo Wii™ Game System and a "Dewy Adventure™" game. (ARV of each Seventh Prize: $299.98) (ARV of all Seventh Prizes: $899.94)

The cash equivalent is permitted with respect to the First and Fourth Prizes only. Neither the cash equivalent nor the transfer or assignment of any other prize is permitted, except at Sponsor's sole discretion. No other substitutions permitted except at the sole discretion of Sponsor. Sponsor makes no warranty with respect to any prize. Sponsor will report value of prizes as required by law. All taxes are sole responsibility of winner. Any expenses not expressly stated herein are the sole responsibility of prizewinners.

ELIGIBILITY/OTHER CONDITIONS: Contest only open to current legal U.S. residents of any of the 50 United States or Washington DC, 18 years of age or older with Internet access as of 9/12/07. Employees of Nestlé Waters North America Inc. ("Sponsor"), its parents, subsidiaries, affiliates, advertising and promotion agencies and the immediate family members of each are not eligible. Contest open to amateur photographers only; professional photographers (persons who have been paid for their photographs or who belong to professional photography associations) are not eligible. Void where prohibited, taxed or otherwise restricted by law. Taxes, if any, are the sole responsibility of the winners. Acceptance of prize constitutes winners' permission for Sponsor to publish the photo submitted and his/her likeness and/or name for advertising purposes without additional compensation, where lawful. Submission of an entry constitutes entrant's irrevocable assignment and transfer to Sponsor of all rights, title and interest in the photograph, including, without limitation, all copyrights. Submission of an entry grants Sponsor the right to modify, edit, adapt, alter, and publish and/or use the photograph or any idea depicted in the photograph in any way, in any and all media, without limitation and without consideration or payment to the entrant. Grand Prize winner and guests will be required to execute an Affidavit of Eligibility/Originality and Publicity/Liability Release. The parents/legal guardians of minor guests of the Grand Prize winner, both on behalf of himself/herself and minor, must complete a release. All First through Seventh Prizewinners will also be required to execute an Affidavit of Eligibility and Publicity/Liability Release. All requested documentation must be returned within fourteen (14) days from the date appearing on the letter of notification or prize will be forfeited. In the event that any potential winner is unable to accept any prize, fails to complete required documentation or cannot fully abide by the prize conditions stated herein, a disqualification will result. In said case, the Contestant with the next highest judged score shall be declared the Grand Prize or First, Second, Third Prize winner, etc., as applicable, in lieu of the prize previously slated for such winner (for example, if the potential Grand Prize winner is disqualified, the First Prize winner will be declared the Grand Prize winner, in lieu of First Prize.

GENERAL: By participating in this Contest, each entrant agrees to: (a) be bound by these Official Rules and decisions of Sponsor and judges, which shall be final, binding and conclusive in all respects and in all matters; (b) release, discharge, indemnify and agree to hold harmless Sponsor and each of its parents, subsidiaries and related companies, advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents ("Designated Parties") from any liability or responsibility whatsoever for any claims, costs, injuries, losses or damages of any kind (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss of, or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light), arising out of, or in connection with, the Contest or from their acceptance, possession, use or misuse of any prize, or participation in the Contest or any Contest -related activity; (c) grant the Sponsor all rights of ownership, reproduction and use of Contest Entries for any purpose whatsoever without consideration, compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-free, worldwide right, in all media (now known or later developed) to use, publish, alter or otherwise exploit Contest Entries without notice, review or approval; and (d) the announcement/use of name, Contest Entry (if any), voice, image and/or likeness for trade, advertising, publicity and promotional purposes without consideration or compensation (unless prohibited by law) by the Sponsor in all media now known or hereafter discovered, worldwide, including but not limited to the Internet, without notice, review or approval and agrees to execute specific consent to such use if asked to do so. In no event shall Sponsor be liable for: (a) telephone, electronic, hardware or software program, network, Internet or computer malfunction, technical errors or by any human error which may occur in the processing of the Contest, votes or the incorrect or inaccurate capture of Contest Entries or other information, or the failure to capture any such information; (b) failed, incomplete, garbled, corrupted or delayed computer transmissions; (c) lost, late, misdirected, mutilated, incomplete or illegible Contest Entries, votes or voter registration information; or (d) any condition caused by events that may cause the Contest to be disrupted or corrupted. Sponsor reserves the right in its sole discretion to cancel or suspend the Contest, or any portion thereof, should computer hardware or software malfunctions (such as, but not limited to, viruses, bugs, worms, tampering, unauthorized intervention, fraud, technical failures) or any other causes corrupt or hamper the administration, security or proper play of the Contest, and select the winners for the Contest from entries received prior to the action taken, or in such other manner as deemed fair and appropriate by Sponsor in its sole discretion.

RELEASE OF LIABILITY: All entrants release Sponsor, D.L. Ryan Companies, Ltd. and each of their respective parents, affiliates, subsidiaries, officers, directors, agents, employees and all others associated with the development and execution of this contest from any and all liability with respect to, or in any way arising from, this Contest and/or use of the prizes, including liability for personal injury or death. Sponsor is not responsible for printing errors.
